Test Pro LLC ("Test Pro," "we," "us," or "our") provides workplace drug and alcohol testing, employer compliance, transportation compliance, and related administrative services. This Privacy Policy explains how information is collected, used, stored, and disclosed when you use the Test Pro website, mobile application, employer portal, driver portal, administrative systems, or related services.

By using our services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

The information we process depends on your relationship with Test Pro and the services you use.

Account and Contact Information

We may process information such as your name, business name, email address, telephone number, mailing or business address, username, account role, employer association, and other information required to create and administer an account.

Driver and Employment-Related Information

For authorized workplace testing and compliance services, we may process driver or employee information such as name, contact information, employer, driver identification information, driver's license information, employment or compliance records, testing requirements, and related documentation.

Drug and Alcohol Testing Information

When necessary to provide testing and compliance services, Test Pro may process information relating to drug or alcohol testing, including test requests, collection information, specimen or test type, Chain of Custody Form (CCF) information, Alcohol Testing Form information, testing status, results, random testing selections, follow-up testing requirements, and related compliance records.

Access to this information is restricted according to account roles and applicable business, contractual, and legal requirements.

Documents and Images

Users may upload or capture documents and images necessary for Test Pro services. These may include driver's licenses, Chain of Custody Forms, testing documents, employer compliance documents, vehicle documents, permits, receipts, certificates, forms, and other records.

Camera and Photo Access

The Test Pro mobile application may request access to your device camera or photo library when you choose to photograph, scan, or upload a document. For example, the camera may be used to scan a CCF or other compliance document. Camera access is used for the functionality requested by the user and is not intended for unrelated monitoring.

Device and Technical Information

We may process limited technical information necessary to operate, secure, troubleshoot, and improve our services, such as device type, operating system, application version, IP address, login activity, timestamps, security events, and diagnostic information.

Portal Activity and Optional Screen Sharing

When you use the Test Pro web portal, we record which portal page you currently have open (the page address and title, not what you type or what is shown on the page), so that Test Pro support staff can see which page you are on while helping you, for example during a phone call.

The web portal also offers an optional "Share my screen with Test Pro" feature. Screen sharing starts only when you choose it and confirm. While it is on, a notice with a share code and a "Stop sharing" button is shown on your screen, and authorized Test Pro support staff can see your portal screen, including what you click and type, so they can guide you. Password, Social Security number, tax identification, bank account, card and PIN fields are hidden on your device and are not transmitted. Screen sharing ends when you stop it, when Test Pro ends it, or automatically after a period of inactivity. The screen recording is deleted automatically, normally within a day after the session ends; we keep a record of when the session took place and which Test Pro staff member viewed it. Screen sharing is available in the web portal only, not in the mobile application.

2. How We Use Information

Test Pro may use information to:

• Provide and administer drug and alcohol testing services;
• Manage employer, driver, and administrator accounts;
• Process test requests and testing documentation;
• Provide DOT and Non-DOT testing and compliance services;
• Administer random testing programs and consortium services;
• Maintain compliance records and documentation;
• Send authorized testing, account, compliance, and service notifications;
• Generate forms, reports, certificates, invoices, and related records;
• Provide customer support;
• Protect accounts and prevent unauthorized access;
• Maintain audit and security records;
• Comply with applicable laws, regulations, contractual obligations, and lawful requests; and
• Maintain, troubleshoot, and improve Test Pro systems and services.

3. How Information May Be Shared

Test Pro does not sell personal information for monetary consideration. We may disclose information when reasonably necessary to provide the services requested or when required or permitted by law.

Depending on the service, information may be disclosed to authorized parties such as:

• The employer or designated employer representative associated with the testing program;
• Authorized Test Pro personnel;
• Laboratories, Medical Review Officers, collection or testing providers, and testing-system providers involved in processing an authorized test;
• Technology, hosting, email, storage, security, or other service providers that support operation of our services;
• Regulatory or governmental authorities when required or authorized by applicable law; and
• Other parties when you direct or authorize us to make the disclosure.

Information is shared according to the purpose of the service, applicable permissions, and relevant legal or contractual requirements.

4. DOT and Regulatory Information

Certain Test Pro services support employers and drivers with transportation and workplace compliance activities, including services related to U.S. Department of Transportation requirements.

Test Pro LLC is a private business and is not a government agency. References to DOT, FMCSA, or other governmental programs are provided for compliance and informational purposes and do not imply endorsement by or affiliation with a government agency.

5. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure. These safeguards may include access controls, authentication, encrypted network communications, role-based permissions, logging, and other security measures.

No electronic storage or transmission method can be guaranteed to be completely secure.

6. Data Retention

We retain information for as long as reasonably necessary to provide our services, maintain business and compliance records, satisfy contractual obligations, resolve disputes, protect our systems, and meet applicable legal or regulatory retention requirements.

Retention periods may differ depending on the type of information and the applicable testing or compliance program.

7. Account and Data Deletion Requests

Users may request deletion of their Test Pro account or eligible personal information by contacting Test Pro LLC.

Certain records may need to be retained when required for regulatory, legal, security, contractual, audit, or compliance purposes. Where retention is required, deletion requests may not result in immediate removal of every record.

8. Children's Privacy

The Test Pro application and services are intended for businesses, employers, authorized personnel, workers, drivers, and other users of workplace testing and compliance services. They are not directed to children.

9. Permissions Used by the Mobile Application

Depending on the device and functionality selected, the Test Pro mobile application may request permissions such as camera or photo/file access for document capture and upload. Permissions are used to provide the corresponding application functionality.

Users can manage device permissions through their operating system settings, although disabling a permission may prevent the associated feature from working.

10. Third-Party Services

Test Pro may use third-party infrastructure and service providers for functions such as hosting, communications, testing administration, document processing, security, and other operational services. Information provided to these parties is limited according to the services they perform and applicable requirements.

11. Your Choices and Rights

Depending on applicable law and the nature of the information, you may have rights or choices regarding access, correction, or deletion of personal information. Requests may be subject to identity verification and applicable legal, regulatory, contractual, and record-retention requirements.

12. SMS / Text Message Communications

If you provide your mobile phone number to Test Pro LLC — typically verbally when you call our office or visit us in person to schedule a drug or alcohol test — you consent to receive text (SMS) messages from us related to that service. These messages are limited to appointment confirmations, scheduling, and other service updates tied to your requested test. We do not send marketing or promotional text messages.

Message frequency varies based on your activity. Message and data rates may apply. You can opt out of text messages at any time by replying STOP to any message from us; you may reply HELP for assistance, or contact our office directly. Opting out of text messages does not affect your testing services or other communications (such as email or phone calls).

We do not sell, rent, or share mobile phone numbers or SMS consent with third parties or affiliates for their own marketing purposes. Phone numbers are used only to provide the service you requested. Mobile carriers are not liable for delayed or undelivered messages.

13. Changes to This Privacy Policy

We may update this Privacy Policy as our services, technology, or legal requirements change. The current version will be published on this page, and the effective date will be updated when appropriate.
